Public Notice to all vendors of products or
services.
Please read carefully. This public notice is official legal
notification of the conditions that you, as vendors
of products or services offered for sale to me (Graeme W. Gill) agree
to, in making a sale directly or
indirectly via representatives, resellers, or any other party, to me.
By agreeing to sell products or
services to me, you acknowledge that you have read this public notice
and are agreeing to the
following conditions:
That all agreements, licenses, terms-of-service,
shrinkwrap,
clickwrap,
browsewrap, confidentiality, non-disclosure,
non-compete and
acceptable use policies,
(End Use License Agreement or other similar
legal notices) enclosed or attached to
the product or service is waived, and that you
acknowledge that even if I appear to agree to
such conditions at any time (for instance as part of a
software installation process
necessary to make use of the products or services
that I have purchased), that I am
in fact not agreeing to such conditions, and
that I retain all rights to make use of the product
or service free of any additional conditions or
restrictions above those imposed by applicable
law. You also agree that this notice and agreement
overrides and supersedes,
and cannot be modified by any such an End Use
License Agreement or other
similar legal notice enclosed or attached to the
product or service.
You further agree that the above conditions can only
be waived or modified by an
agreement in writing, signed by both parties
prior to sale.
